Research On The Judicial Credibility In Minority Region

The credibility of the judiciary generally refers to a legal culture influence that a certain society in a specific historical period,in the scope of social justice system and legal management system resources,the legal state communicate with the public rationally through a peaceful way,based on the mainstream of the legal value pursuit,recognition,faith and trust,the government and the public reach a consensus on the overall authority of social systems in judicial engineering and obey voluntarily.The public convincing degree of judicial credibility in the judicial construction field embodies the self-discipline of the existing law,the impartiality of the judicial trial? the credibility of judicial procedure?enforceability of judicial decisions and public faith and compliance etc.From the The eighteenth national congress of the CPC,along with the accelerated pace of constructs in the Chinese characteristic socialism country under the rule of law,the cognition of the judicial credibility is increasing,the government began to strengthen the construction of judicial credibility and make efforts to enhance it.The judicial reform in our country has experienced nearly thirty years,it has made considerable achievements,but due to the historical and realistic reasons of long-term hindrance,the status of the judicial credibility is anxious,the weak judicial openness ? alienation of judicial power ? frequently occurring team construction problem of court officers and the lack of enforcement remains to be solved,due to the backward economic and social development factors,the judicial credibility problem is particularly prominent in ethnic areas,enhancing the credibility of the judiciary is imminent.Therefore,it is of great theoretical and practical significance to research on promotion path of judicial credibility in ethnic areas.Studied from the perspective of judicial credibility and the analysis of the current situation and the causes of the formation of the judicial credibility in the ethnic areas,the author puts forward the way to improve the judicial credibility of the ethnic areas.This article is composed of three parts: the first part is the basic theory,it defines the judicial credibility through the analysis of the connotation and denotation of judicial concept,and points out the nature and the basic requirements of the judicial credibility;The second part represents the status and causes of the judicial credibility,started from the general situation of the judicial credibility,it analysis the current situation of judicial credibility in ethnic minorities in China and its causes;The countermeasure analysis is referred in the third part,based on analyzing the particularity of the judicial system in minorities,proposed how to strengthen the judicial construction of it,and put forward specific measures to enhance the credibility of the judiciary in minorities aimed at the particularity of the judicial system in minority areas.
