Study On The Legislation Of Administrative Organization Law

At present,there are some problems to be solved in the study of administrative organization law in China,such as legislative progress slowly,practice standard fuzzy and the lack of regulate.The eighteenth session the fourth plenary meeting of the Central Committee of the Communist Party of China examined and adopted the "CPC Central Committee comprehensively promote the rule of law in certain major issue decision"particularly emphasis on the "Implement government functions fully according to law.Perfect the law system of administrative organization and the administrative procedure,propel the Legalization of mechanism,functions,authority,procedures and responsibility".There is very important significance to accelerate the pace of the construction of the country under the rule of law,the government under the rule of law,and the society the rule of law on the study of administrative organization law,so it is of importance and urgency to research it at this stage.This paper is divided into five parts:the first chapter is introduction,which introduces the background,the purpose and the significance of the thesis;the second chapter is the definition of administrative organization law and its related concepts,which defines the related concept of administrative organization and administrative organization law,establishes the basic principles of administrative law,introduces the history and status of administrative law;the third chapter analyzes the existing problems of China's administrative law and the reasons,summarizes the existing problems of China's administrative law,and analyzes the reason of the existing problems of China's administrative law;the fourth chapter introduces the status and the enlightenment of foreign administrative law legislation,introduces the current legislation of the foreign administrative organization law for the example of Japan and Britain,and get the enlightenment to China;the fifth chapter is some relevant suggestions to improve China's administrative law legislation,puts forward the legislative system to clear the administrative organization law,as same as to perfect the legislative procedure and supervision mechanism of administrative organization law.It is the key to the reform of government institutions to strengthen and perfect the legislation of administrative organization law,which not only is helpful to standardize the administrative disorder state,ensure the implementation of administration according to law,but also has the irreplaceable important role in promoting the process of the administrative rule of law and democracy.Administrative organization legislation is a foundation engineering related to the administrative development and the government construction according to the rule of law,if the administrative organization legislation is not perfectly,the reform of the administrative system will be not smooth.
