Research On Legal Settlement Mechanism Of Property Service Disputes

Property services started late in our country,and corresponding laws and regulations is not sound,frequent realty service legal disputes have became the social hot spots.This is related to every people's vital interests,if not handled properly,will cause sudden events,mass incidents or petition.Because property dispute resolution mechanism in reality seriously lagging behind the social needs,so innovation of dispute settlement mechanism is an important topic.Our existing property dispute resolution system in litigation mode is given priority to,the non-lawsuit way is complementary,the program does not reflect concise and efficient.As a result,this paper suggests on the basis of the mechanism,actively explore the linkage of the people's mediation,administrative mediation and judicial mediation mechanism,to improve the non-lawsuit environment,to carry on fast accept property disputes,rapid processing,rapid execution,simplify the processing procedure,make the property disputes through the interaction of multiple departments to get fast resolution.This article altogether is divided into four parts except preface and conclusion.The first part introduces a typical case--Ms.Wei appealed a property company;the second part introduces the summarized from the above case to the problems of property dispute solution in our country;the third part points out the see from case main problems of property dispute solution mechanism in our country,for example: the law is not specific,the professionals lack and such problems as weak linkage between dispute resolution organization.In the fourth part focuses on the problems existing in the research property dispute resolution mechanism,from the perspective of law and practice.From the concrete case and combining to participate in the research on our country's realty service legal dispute mechanism analysis of existing problems and reasons,finding any shortfall in the settlement mechanism,using the experience ofrelevant legislation and practice,through learning foreign advanced experience and innovation mechanism of settlement,to find a suitable solution of realty service in our country's legal dispute.
