Research On The Subject Of Campus Loan Legal Relationship

In recent years,with the rapid rise of the Internet finance,the fast growing of network lending institutions has become an important social issue.Nowadays,due to the pursuit of fashion,college students have a strong desire for consumption.The lenders of campus loan build financial platform for students and students can afford excessive consumptions.Some students purchase mobile phone,computer and other items through campus loan platform without control.Since students have no fixed income,they are unable to repay the loans and their parents have to bear the repayment pressure.At the same time,some campus loan platforms lower the threshold for students,and simplify the process,inducing the increasing risk of default.And then leading to the illegal usury and violent collector because of lacking legal regulation and supervision.These facts result in students' suicide because they cannot repay the loans.Therefore,this paper studies the legal problem of the subjects of campus loan through case analysis and relevant policies,laws and regulations.This paper discusses the following three parts.The first part is the introduction of the case,and then discusses the problems reflected by this case.Zheng Dexing,a student of Zhengzhou City College,who was unable to pay the high campus loans and committed a suicide.The second part is the analysis of the legal problems in this case.Firstly,analyzing the legal problems of lender.Specifically,the qualification of the borrower,the default rate of loan and the match of lending and borrowing amount of money.Secondly,the legal problem of supervisor.Thirdly,the legal problem of borrower.The third part is the suggestion of campus loan platform in the sight of law.Establishing the qualification admittance system for campus loan,improving the regulation of supervisor and enhancing the construction of credit system.The campus loan has become a social problem,so the research of legal problems contributes to a healthy development for network loan and online financial market in China.
