Studies On Expert Jury System

With the continuous development of economy,the type of cases is becoming more and more complicated,which brings judicial practice huge challenge.So,the judiciary keeps pace with the times and try to explore and perfect the judicial system including expert jury system.This article comprehensively combs and analyzes the situation?problems and reasons of expert jury system at this stage of our country by combining empirical analysis and theoretical analysis and come up with some methods of further improvement.The article is divided into five parts.The first part named introduction,mainly introduces the background?significance of this topic,and put forward writing ideas on the basis of comprehensive analysis of the result of current academic research on this subject in our country.The second part is the legal analysis of expert jury system.On the basis of clearing the concept characteristics and related concepts of expert jury system,we analyze the theory such as people's sovereignty principle and Marxist theory of social division of labor to reveal the theoretical value of the existence of the system.The third part is situation analysis of expert jury system.In this part,we mainly use empirical analysis including questionnaire survey?field survey and sample survey to compare and study how the system is running.The charts we made by using these data can intuitively reflect the problems and reasons in the process of expert jury system operation.The fourth part is about the analysis and reference of foreign expert jury system.We can summarize the experience and deficiencies of foreign expert jury system on the basis of comparing this system in different countries.The fundamental purpose is to learn foreign advanced experience to perfect expert jury system in our country.The last part is perfecting the expert jury system in China and it is the most important part in this article.We will discuss from four aspects:thelegal nature and function of this system?selection conditions and procedures of expert jurors?the scope of the cases expert jurors join in and the line with other jury systems.Discussion in detail is to propose methods and measures of perfecting our country's expert jury system and which is help to promote the pace of development of expert jury system.In conclusion,through analysis and research,this article aims at complying with the tide of judicial reform and making the expert jury system really play a role in the judicial practice which contribute to achieve the fundamental purpose of judicial justice.
