Research On The Expert Jury System In My Country

The people's jury system is an important part of the socialist judicial system with Chinese characteristics and an important embodiment of the socialist democratic system in the judicial field.The enactment of the People's Jurors Act of April 27,2018 reflects our country's emphasis on the people's jury system.The original intention of this law is to solve the phenomena of "jury without trial","trial without dispute" and "judge in court" appearing in our jury system.However,the power of the people's jurors in our country lacks the core reform in the judicial reform.It only draws lessons from the Anglo-American jury system in the form of trial,which cannot solve the above problems.It is hoped that the purpose of perfecting the people's jury system in our country can be achieved by reconstructing the functions and powers of the people's jurors.The paper is divided into four parts.The first part mainly introduces the provisions of the people's jurors' functions and powers in the relevant laws,and analyses the present situation of the people's jurors' functions and powers according to the forms,and summarizes the problems existing in the people's jurors' functions and powers.The second part mainly analyses the jury system of Anglo-American law system and the jury system of continental law system,and finds out the advantages that can be used for reference by comparing the two legal systems.The third part is analysis of the functions and powers of the people's jurors.This part re-analyses the function orientation of the people's jurors' powers,clarifies the role of the jury system in the judicial system of our country,and puts forward suggestions for improving the existing problems of the people's jurors' powers.Finally,the author puts forward the idea of reconstructing the functions and powers of the people's jurors in our country.
