Research Of The Protection Of Personal Data Under The Background Of National Security

As the increasing development of Cloud Computing technology and the IOT(Internet of Things),the ability of collecting and handling data of computers is also evolved,and it makes data become more useful than former times.Nowadays,the differences between personal data and personal information has become fewer.The issue of the protection of personal data is always a hot topic within researchers,especially with the development of the Cloud Computing technology and the using of them in enterprises.The researchers choose to study how to protect personal data in this aspect which is based on analyzing the nature of technology.And they already have a break out on the aspect of the personal data rights,the protecting method of the right of privacy and the structure of personal data legal system.However,the scholar always focus on how to protect the right of privacy and how to make sure the human rights.They believe that the core of issue which is about the protection of personal data is to protect the personality rights and property rights,which is totally separated from national security.The aspect of the study of this issue is insubstantial,although the issue is closely related to individuals,it's also related to national security as the development of Cloud Computing Technology makes personal data become more and more useful.If the personal data are out of control,our national security will be influenced.In the age of Big Data,there are many aspects of potential security risks in the Cloud Computing and IOT,which are aspects of adoption,Internet level and physical level.Meanwhile,these potential security risks will be harmful to the protection of personal data in the management level in enterprises and public departments,and if the personal data have been disclosure to the society,the national security will also be affected.The existing legal system cannot protect the security of personal data in this technology environment,and it will be useless to make personal data protection law sorely.We should make a personal data protection system which is leaded by information security collaborative theory.First of all,we should make complete law of personal data protection,which is aim to realize the value goal of make sure national information security and the human rights.This law also needs to establish the basic principle and the definition of personal data,which is the basic of the execution of the system.Then,we should structure the collaborative system of data protection,which is aim to prevent public departments from abusing personal data.This system should build the Internet technology examine mechanism and the data regulations to improve the network lawful interception system.At last,we need to build perfect industry standard of protection of personal data.
