Legal Protection For Personal Information Under Big Data Background

With the Big Data coming,the protection for personal information is facing great challenges.The traditional protection mode for privacy right has been no longer satisfying for the protection for personal information security.Personal information requests more legal protection.In the new promulgated Cyber Security Law of our country,there are some creative rules and regulations regarding the protection for personal information and the other documents following promulgated have also put forward the new direction of the protection for personal information.This thesis has analyzed the existing problems in the protection for personal information in our country based on several practical cases and the reasons caused such problems based on the laws,regulations and documents promulgated after the promulgation of Cyber Security Law.Then,based on those analysis,this thesis provides some suggestions accordingly on the basis of combination of excellent experience of the protection for personal information abroad and the contents which are proposed useful in some non-mandatory documents promulgated in our country,including to distinguish the categories of personal information,acknowledge personal information right as well as alter the authorization mode of information subject,and other suggestions to perfect the protection for personal information.
