Research On Juvenile Criminal Record Sealed System

The introduction of the new "Code of Criminal Procedure" for China’s juvenile justice system is a milestone development.One of the highlights is the development of a system of juvenile criminal record sealed system.The system has a great help for juveniles’ education and employment.However,the legal provisions of the juvenile criminal record sealed system in the new "Code of Criminal Procedure" is not perfect.Actually these legal provisions are too general,which will have a direct negative effect on the implementation of the system.In this paper,the author analyzes the connotation and significance of the criminal record sealed system and finds out the shortcomings of the system and puts forward some suggestions on these deficiencies.The thesis is divided into the following parts:The first part is the introduction,which mainly focus on the background and significance of the juvenile criminal record sealed system.The research content,research methods and research results at our country and abroad were briefly described.The second part introduces the basic idea of the juvenile criminal record sealed system.It is mainly from the legitimacy of criminal record sealed,the value orientation and the legal meaning of the system.The third part mainly introduces the current international legislation and the mainstream trend of the international community is to stipulate the crime record elimination system.Criminal record sealed system is only as a transitional step.Foreign legislation is in detail,so some advanced ideas are worthy of our legislation.In the fourth part,for some of the legislative deficiencies in the system,the author puts forward her own suggestions for improvement.
