Research On Record Filing System Of Juvenile Delinquency In China

The juvenile criminal record sequestration system,as a new institutional component of the 2012 Criminal Procedure Law,aims to reduce the negative influence of cri minal labels on minors and helps juvenile offenders to better return to the society.It is important to the practice of judicial.Since the application of the system in China is at the primary stage,the provisions of the law for the system have yet to be improved.The first three parts of this article have conducted a detailed analysis of the theoretical basis,legislation and practice exploration,and current problems.First of all,the system is in conflict with many systems and lacks system coordination.Second,it also lacks provisions on the subject,procedure and storage responsibility of the closure.Finally,some provisions of the system are too general.The poor operability can easily lead to the system failing to give full play to its maximun value.The last part of this article makes suggestions on the above deficiencies.First of all,it is suggested that relevant laws and regulations be appropriately modified to help the system play its greatest value,and secondly that its main body of containment should be the person who knows the criminal records of minors.Finally,i suggest that expanding the extend of juvenile offenders to who had committed more than five years of negligent crimes and give my idear on the design of storage and inquiry procedures.
