Research On Legal Mechanism About Prevention Of Divulging Personal Information In E-bank Under The Comparison Of Legislation Between China And Japan

With the development of Internet,Banking business gradually expanded from offline to online,E-bank business has become the mainstream.The security of personal information is the premise for E-banks to operate persistently,stably,safely,in recent years,as the personal information law is still not perfect,the divulging of personal information hold by E-bank occurred frequently under the environment of internet,bring more huge property risk to personal information of the customer,therefore,how to prevent the risk of divulge of personal information hold by E-bank,and protect the security of online banking system becomes a difficult problem.The essence of risk prevention of divulging personal information in E-bank is a comprehensive legal problem related to technique and finance.This makes the use of legal means to prevent the risk of divulging personal information in E-bank become inevitable.This paper attempts to breakthrough from the point of view of the risk of divulging personal information in E-bank,based on analyses of the current E-bank personal information on the current situation.This paper analyzes the reasons about risk of divulging personal information in E-bank from aspects of the enterprise,government,society,technology and so on,and further analyzes the relevant legal system of Chinese and some developed countries in risk prevention of divulging personal information in E-bank,put forward the ideas and methods of solving the problems,so as to achieve the security of personal information.Through the research,this paper analyzes risks hide in divulging personal information deeply,and puts forward some corresponding preventive measures.It has important practical significance to promote China's E-bank for the healthy development,and it will help to promote the development of China's financial industry,healthy operation and rational use of personal information.This paper consists of six parts.The first part is the introduction which introduces the research background and significance of this paper;both at home and abroad for the research of E-bank and security legal system of E-bank,research methods and research innovation.The second part is the introduction of the concepts of the E-bank,personal information and the theories related to the protection of personal information and the analyses on the risk in divulging.The third part introduces the current risk prevention system about divulging personal information in E-bank of China,and analyzes the defects in current system.The fourth part does a research on the legal rules about risk prevention of divulging personal information in E-bank in Japan,analyzes the personal information protection legislation mode of Japan,the basic principles and specific systems.The fifth part puts forward some suggestions on China's legal rules about risk prevention of divulging personal information in E-bank,according to the legislative experience of Japan and the present situation of China,including the basic principles and the specific legal system.The last part is the conclusion which summarizes the full paper.
