A Study On Legal Relief Mechanism Of Ecological Damage Between China And Foreign Countries

Since the industrial revolution,with the progress of technology,human development and utilization of natural ability is greatly enhanced,ecological damage problem is more severe.At the same time,due to the environment to the discharge of more and more man-made materials,environmental pollution problems are also highlighted.In the contemporary era,ecological damage and environmental pollution are intertwined,and the frequent natural disasters have brought about an unprecedented ecological dilemma for mankind.In this paper,based on the distinction between environmental damage and ecological damage,through the Songhua River water pollution case,the Bohai Sea Conoco Phillips oil spill,the Bohai Tasman Sea cruise large oil spill case analysis of China's current ecological damage relief,relief,damage Compensation assessment methods,and environmental compliance and enforcement.At the same time,compared with Chevron Brazil oil spill,BP oil company in the Gulf of Mexico oil well exploded the ecological damage relief,as well as the United States,Brazil ecological legislation,to analyze the lack of relief of ecological damage.This paper intends to complete the study by normative research method,comparative research method and case analysis method.The problem of ecological tort law is based on a certain theoretical basis.The research in this subject needs to analyze the case of ecological problems in theory at the same time,combined with the existing laws and regulations of ecological environment,the cost and benefit of ecological problem management,The legal theory of environmental litigation and other basic theoretical analysis.
