Characteristic Analysis And Typical Case Study Of Criminal Cases Contaminating The Environment

With the rapid development of modern industrialization,the problem of environmental pollution in China has been aggravated year by year.According to China's Ministry of Environmental Protection,China's industrial solid waste production reached 3.27 billion tons in 2015,including 39.7611 million tons of industrial hazardous waste,an increase of 26.19 million tons compared with 13.57 million tons of hazardous solid waste in 2008.Survey statistics until 2015,there are866 hazardous waste treatment plants and medical waste treatment sites are 246 in China,and the comprehensive utilization of hazardous waste reaches 509.8 million tons and the disposal volume is 521.9 million tons.At present,our country mainly produce hazardous waste including waste,asbestos waste,waste acid,non-ferrous metal smelting slag,inorganic chloride,waste mineral oil and other hazardous waste etc.Until 2015 the number of licensed enterprises with hazardous waste in China was 2034.The actual operation scale of the national hazardous waste management unit is 1536 million tons,and the actual disposal amount is 426 million tons,which accounts for about 11% of the total amount of hazardous waste produced in the whole year.Due to the high cost of disposal by qualified hazardous waste management units,some enterprises and small workshops have caused great damage to the environment in order to maximize their profits,discharge illegally and dispose of hazardous wastes.The research is based on the criminal cases of environmental pollution cases in Liaoning Province over the years.Through typical cases to study assessment report of environmental damage,according to the basic circumstances,the characteristics,the sources of pollution,the types of pollution,the penalties of environmental cases carry out analysis.This paper summarizes the evolution law of criminal cases of pollution environment in Liaoning Province,and puts forward some suggestions and opinions in view of the existing problems.Through the analysis of typical criminal cases of environmental pollution,thispaper puts forward various problems existing in the environmental pollution accidents at present,and provides a reference for further research.There are various forms of environmental pollution cases,and the types of pollutants are complex in China.The evidence of the case requires a professional identification of environmental pollution,disposal of pollutants and late remediation of contaminated sites cannot be completed in time.Therefore,the assessment report of environmental damage assessment plays an important role in environmental protection in the later stage of environmental pollution cases.The appraisal report of environmental damage is of great importance to the environmental protection in the late stage of environmental pollution cases.However,the cost of environmental pollution identification is of too high,the relevant departments do not have such special case funds.It is the key to solve the problem to construct the environmental damage assessment report in the criminal case of environmental pollution.As a basis for the analysis of the related literature of environmental damage assessment and assessment,and summing up the criminal law of environmental pollution cases decided by Liaoning Province in 2014-2017.This paper summarizes the evolution law of criminal cases of environmental pollution in China and the present situation of environmental damage appraisal and evaluation.Some suggestions are put forward for the effective combination of environmental damage assessment and criminal cases of environmental pollution.Improving the management of the assessment and evaluation of environmental damage.Perfecting the penalty system of domestic pollution environment and the procedure management of the criminal case of pollution environment.It is also provides some suggestions for the investigation procedure of environmental pollution violations in China,and has reference and guidance significance for the conviction and sentencing of environmental pollution criminal cases in the future.
