Research On Patent Right Protection Of Business Model Under "Internet+"

As a result of the continuous development of the Internet,a large part of the industry have introduced the Internet-related technology,and with the large-scale use of the Internet,some of the traditional business model has disruptively changed,such the following industries as transportation,health care,finance,education.However,the development of the existing patent protection system is lagging behind.The business model is easy to be imitated and copied,and then disorderly competition,infringement occurred frequently,and so the lack of effective patent protection seriously hindered the development of enterprises.So,the completion of the"Internet +" business model of the patent and its protection are one of the most important issues.Business model as an important part of the enterprise,business model patents have become one of the cores of competition among enterprises in the world.In the 1990s,the United States took the lead in completing the commercialization of the business model,at the same time,in order to ensure the sustainability of the interests of many countries in Europe and Japan have passed the commercial model of patent law.China's patent awareness is still very weak and the importance of patent protection can not be recognized,so the law issue whether the business model can be patented in China was put forward relatively late.In China's current patent protection laws and regulations,the business model of the patent protection is clearly defined for the new version of Patent Review Guide,which reads the projects applying for business model patent needs have a certain technique,but does not give specific instructions of standards and audit standards of the technique.Once the large-scale followed,"Internet +" business model is a technical business model different from the simple thinking,methods,and it will cause huge economic losses,so it is very necessary to provide patent protection for the "Internet +" business model.Based on the concept of "Internet +" business model and the difference of general business model,this paper analyzes the status quo of patent protection of business model both at home and abroad,and makes a systematic analysis of the patent application of "Internet +" business model.Problem,fully aware of the "Internet+" business model patent protection of the importance.At the same time,it analyzes the existing problems in the existing patent system and puts forward some suggestions on these problems,and constantly improves the relevant laws of patent protection,deepens the understanding of patent protection and promotes the innovation of enterprises.
