Theoretical Research On Global Protection Of Intellectual Property

The global intellectual property protection has become one of the world's economy,science and technology,culture and international trade an important legal order,and the “TRIPS agreement” is a direct result of the global intellectual property protection and theoretical basis.International intellectual property protection standards in international integration,and the integration of international protection rules reflect the basic characteristics of the intellectual property system.In the trend of economic globalization,intellectual property is increasingly mixed together with international trade,showing the development of new features,and intellectual property rights has become the country's economic interests constitute an important part.The global protection of intellectual property has regional characteristics,which is difficult to eliminate.In the global protection of intellectual property rights,we must follow the most favored nation treatment principle,national treatment principle,transparency principle,etc..However,with the development of the current economic development of science and technology,the problem of global intellectual property protection again put forward new principles,such as eliminating the development gap between the weak and strong and the principle of respect for human rights.China's useful exploration of the protection of intellectual property can be traced back to the 1970 s,after joining the World Trade Organization WTO,with the world more closely,through continuous learning from the world to protect intellectual property rights and effective methods,and now our country has established a Sets of more comprehensive intellectual property protection legal system.In the formulation of domestic law,the representative is the “Trademark Law” and “Copyright Law” introduced.A representative of the international treaties is the accession to the TRIPS Agreement.Through continuous learning and improvement,China has made remarkable achievements in the field of intellectual property legislation and law enforcement.But after all,China is still a developing country in the world,therefore,the protection of intellectual property rights there are many deficiencies,such as domestic law is still not perfect,the international rules of the understanding is not comprehensive and so on,all these problems need us to solve.This study is based on the above considerations,the present situation of international protection of intellectual property rights,especially the study of the “TRIPS agreement” of a comprehensive analysis of the shortcomings of the current theoretical issues related to the global intellectual property protection and the development of the status quo,and focuses on the analysis of the status of the global protection of intellectual property rights in China,and puts forward the solutions countermeasures.
