Study On Internet Drug Crime

In recent years,the rapid development of the Internet has enabled people to enjoy a much convenient and fast life.But every coin has two sides,drug criminals have expanded their crimes to the Internet,which will bring great damage to the whole society.In October 2011,public security organs at all levels have jointly took actions under the command of Ministry of Public Security and successfully detected "8·31large online drug trafficking and abusing",which is the first case of Internet drug crime in our country.It features trans-regions,more personnel involved,and extensive drugs and brings great attention of Internet drugs to experts and scholars.Therefore,it is an urgent task to attack online drug crime.This article mainly discusses four parts:The first part explains the background,current situation and trend of Internet drug crime.With the progress of science and technology and the constantly increased connection with the Internet,drug crime like other traditional crimes has developed more forms and barriers against it have been constantly broke under the re-packaging of the Internet.If the network platforms are deliberately used,it will be transformed into a malignant stage for studying and exchanging criminal methods and disseminating criminal results.The second part introduces behaviors and characteristics of online drug crime.In the virtual space,some private chat rooms have been abused by criminals to exchange with drug,abuse drug collectively,induce others to take drugs,take the opportunity to sell drugs,and teach a series of drug making method and other extremely harmful behaviors.Taking advantage of features of the Internet such as trans-region,intelligence,low costs and risk,criminals try to bruit drug information.Such actions have violated the initial purpose of establishing green and pure cyberspace,corrupted the normal values in the society,and poisoned physical and mental health of many young people.The third part discusses some disputed issues concerning current Internet drug crime.How to define organizing multiplayer abuse performance is a divergent issue.The main point of view about this issue is divided into the followings:accommodation and spread crime,the dichotomy,non-crime,the definition of the "Ninth Criminal Law Amendment" and other juridical interpretation.And whether the online information service workers providing technological support constitute a crime is also disputed.For Internet + the logistics delivery industry,as a key component of offline drug deal,in contemporary age is playing more and more important role,the study of its behavior and the status qua is conducive to combat the online drug crime.The fourth part mainly discusses how to regulate the criminal law governing the current online drug crime from three aspects of the standardization of logistics channels,the legislation of cyber drug crime and the criminal law of cybercrime crime.
