As a new Internet financial model,since the birth of the product crowdfunding,it has been developing rapidly,it has combined with other industries such as technology,film and television,music,etc.,and it has appeared a number of quality projects that are innovative and influential,it has encouraged grassroots entrepreneurial groups mainly based on individual and small entrepreneurial teams,and it has promoted the construction of the whole society innovation and entrepreneurship atmosphere.But at the same time,the problem is accompanied by its vigorous development: Due to the nature of the product crowdfunding has both commodity preorder and investment,therefore,the existing laws and regulations cannot be fully applicable,it causes the perplexity of the lack of external supervision;The whole industry has not yet formed a clear unified industry norms in the information audit,project management,it causes the internal industry also in a state of disorder.As a result,the effective supervision of all product crowdfunding currently is an important way to reduce the problem of financing,it has positive practical significance to guide our product crowdfunding platform to conduct business according to law,regain confidence of supporters,encourage innovation and entrepreneurship,promote the healthy development of the industry,there are five chapters in this paper.The first chapter mainly introduces the connotation,characteristics and basic operation mode of the product crowdfunding,Combes three main body in product crowdfunding activities,project sponsors,supporters and platform,and combined with the existing laws and regulations and judicial practice,the author discusses the legal relationship between them,then clears the rights and obligations of each participant.The second chapter explains the existing problems of products to raise public sector in the current operation,mainly starts from three aspects of platform operation,intellectual property rights and supporters’ rights,combined with the actual investigation and analysis.The third chapter analyzes the reasons for the frequent problems of the product crowdfunding,theoretical analysis is carried out from the perspective of economics and sociology,and then points out the influence of many factors in realistic level.The fourth chapter discusses the current regulatory status of products to raise public sector in our country,then introduces the foreign(mainly the United States and the European Union)regulatory measures,and extracts the supervisory experience of commeness,and finally sums up on China’s regulatory significance.In the fifth chapter,according to the content of the previous study and the development of our product crowdfunding,it puts forward some suggestions to improve the public supervision of the product crowdfunding.Firstly,in macro aspect,we should adhere to the guide of taking the principle of regulation primarily,and regulation as complementary,gradually transforming into mixed supervision mode,supervises from the source,process and afterwards;And then,in microcosmic aspect,taking corresponding measures concretely according to platform operation supervision,intellectual property protection,other regulatory measures as complementary,jointly promote the healthy development of the product crowdfunding industry.
