The Twelfth Five-Year Plan says that the logistics industry is so important that it creates a new economic growth point and is beneficial for international competition.We began to value the logistics industry in the 1990's,but now it is a crucial period of transition from traditional logistics to modern logistics for us Chinese people.Because of starting late,the legal system of logistics industry access is not perfect.With the development of economic globalization and international trade,the legal system of logistics industry access in China should conform to global trade rules so that we can readjust to the development of modern logistics.Therefore,the scientific and logical legal system of logistics industry access can promote the logistics industry and increase its profitability and competitiveness all over the world.I mainly adopt comparative method,bibliographical reference method and empirica method to systematically study the legal system of logistics industry access in China.The first chapter mainly tells about the conception of the legal system of logistics industry access,including the notion of logistics industry,market access and logistics market access.Then I analyze the functions of the legal system of logistics industry access such as on the promotion of the enterprise organizational structure transformation,the prevention of setting up enterprises at random,the optimization of industrial structure and defining the power boundary.Then the second chapter tells about present situation including legislative progression and the relevant legal documents of the legal system of logistics industry access in China in the right of domestic-investment and overseas investment logistics industry.On this basis,I begin the third section with the analysis of problems of the legal system of logistics industry access in China.The vagueness of coordination of legal system,the absence of specific systems and regulatory barriers are all involved in the problems.So are the high requirements and narrow range of overseas investment.At the same time,the absence of matching systems is also one of our problems.The fourth chapter introduces the legal system of logistics industry access of The US and Japan.After learning from the two countries,I come to the conclusion that we are supposed to build jurisprudence,unify law enforcement agency,weaken the regulation of access and Take macro-control policies.At last,on ournational conditions,the fifth part discusses the advice learned from the experience of the developed countries.First of all,we should clarify the fundamental principle.And then I give specific advice about domestic-investment and overseas investment logistics industry legal system.At the same time,the writer put forward to the matching system of logistics market access.
