With the development of our market economy and the deepening of reform and opening up,a large floating population has become a significant feature of modern society,it has had a huge impact on the traditional economy to the credit transaction based in china.In order to solve the potential risks caused by the information asymmetry,the system of individual credit system is established in China.It not only can offer the information with which the transaction will be subject to the credit status of third people or institutions,but also conducive to promoting the construction of social credit,but the existence of the agency is to collect personal credit information as the premise,the credit information of a large part of personal privacy category.Therefore,the conflict between personal credit reporting and the protection of privacy is inevitable.This article is from the conflict of personal credit information and privacy protection from the angle of legislation through the study of foreign personal credit information and privacy protection,and the practice and legislation of our country,the comprehensive use of empirical analysis and comparative research methods,and puts forward some countermeasures for our country in the personal credit information privacy protection.This paper except the introduction and conclusion,is divided into five parts,the first part of the personal credit and the right of privacy concept is reviewed,so after the writing has a clear concept of support.Mainly includes the overview of credit investigation,the overview of the right to privacy and the characteristics of the right to privacy in the personal credit investigation.The second part explains the conflict and balance between personal credit reporting and privacy protection.The third part of the United States and the European Union legislation,this paper respectively from the responsibility and personal credit report,credit credit program,the information users for the purpose of use of the personal credit information subject in privacy protection comparative analysis.The fourth part points out the legislative status and defects of China's personal credit information privacy protection.In the fifth part of China's personal credit information privacy protection legislation status and defects,and learn from the legislative experience of western countries,put forward the protection of right of privacy from three aspects of basic principles,to protect the privacy of personal credit privacy protection measures and privacy protection system etc.
