Although there is no stipulation in ?Administrative Litigation Law?(version 1989)for responsible persons in administrative organ responding to lawsuit,but some of the provisions contains the requirements and encouragements of the spirits and value to appear in court litigation.In promoting the administrative organ to appear in court specify in new Administrative Litigation Law,the state council and many local governments developed a series of administrative documents and played an important role in the way by a lot of practice to explore.The revised version of Administrative Litigation Law issued in May2015 established the system of court investigations by the responsible person of the administrative organ.But it's not easy to operate and perform because of principle and non-specific.?The opinions of strengthen and improvement of administrative litigation?which issued by the state council on June 27 th 2016 also has the same problem.It gives us the space to explore the path of improvement.Based on the analysis on the basis of the improvement of the several possible paths,come forward the state council shall give advice of strengthening the administrative organ to appear in court litigation,to guide the national administrative authorities at various levels,and puts forward ideas and suggestions on the design of the specific content.Including: fully understand the importance of strengthening administrative organs to appear in court litigation;the specification of strengthening administrative organs to appear in court litigation;the safeguard measures of strengthening administrative organs to appear in court litigation,and on this basis,draw up the academic recommendations.
