service invention of Chinese university exists low patent quality and low implementation rate,seriously affecting the university's support for national science and technology development role.From benefit-oriented,the essentially problem existing in the regime of universities' service invention is "interest" which can't inspire the enthusiasm of all parties.Therefore,this paper focuses on the study of regime of benefit sharing of universities' service invention.Firstly,this paper is based on the discussion of the basic theory of the regime of benefit sharing of universities' service invention.Defining the definition and scope of universities' service invention,This paper founds that the universities' service invention is created in the researchers' field of profession or by the main use of university material and technical conditions in universities.Analyzing the demand of interests of the university and the researcher,the function of the benefit sharing mainly includes: stimulating innovation,promoting implementation and balance of interests.The composition of the regime of benefit sharing includes: Ownership rights,Matching rights and Income distribution.Secondly,in the discussion of the positioning of Ownership of rights of the universities' service invention,the paper believes that the Ownership of rights has a clear incentive function.Summing up the introduction of the existing law of domestic and overseas,we found three kinds of the Ownership rights model: employee priority model,employer priority model,Common model.From the analysis of the evaluation index of incentive,participation and efficiency,it is found that the employee priority model is the best.Chinese law can't play a stimulating role.This paper analyzes the reality of our country to propose to retain the employer priority model and suggests improving the regulation of "agreed priority;no agreement to the university."Thirdly,in the discussion of the establishment of the matching right of the universities' service invention,the paper clarifies the proving function of it.Foreign countries emphasis on that the law protects the inventor's spiritual and material rights,particularly the right of authorship,the right of getting paid,and the right of relief.From the perspective of the inventor to promote the implementation of the universities' service invention,this paper sets up the following of matching rights: the right of authorship,the right of getting paid,the right of priority application and implement,the right to know and the right of relief.Lastly,in the discussion of the distribution of income about the universities' service invention,the paper believes that the distribution of income must reach the function of balance.Chinese horizontal project management approach does not apply to the management of income distribution.We should learn from domestic and foreign research or regulations,determining the object of income distribution is net income which is deduct the cost and the taxable,and refining the calculation of income distribution.The paper tries to determine the distribution of ratio between university and inventor,standardize the use of part of the university,and make a reasonable determination of the distribution between inventors.
