At present,there is a big gap between China and the world’s advanced technology.It is necessary to mobilize the enthusiasm of science and technology workers at the institutional level and provide strong support for the development of science and technology.Premier Li Keqiang clearly pointed out in the report on the work of the government that it is essential to explore giving scientific and technological personnel the ownership and long-term use right of scientific and technological achievements.Therefore,it is urgent to ensure the smooth transformation of scientific and technological achievements.Based on the transformation of scientific and technological achievements in Colleges and universities,this paper discusses the ownership of the right of service invention in Colleges and universities.The conversion rate of scientific and technological achievements in Colleges and universities in China is far lower than that of enterprises.Its conversion rate is only less than 5%.In addition,the annual patent application fee and the cost of maintaining the patent make the profits of patent conversion more than make ends meet,so many patents in Colleges and universities are idle.The ownership of patent rights in Chinese universities needs to be further studied.Therefore,this paper will start with the theoretical and normative basis of the ownership system of service invention,investigate the status quo and pilot situation of the ownership of service invention rights in Colleges and universities,draw on the advanced experience of foreign countries represented by American and Japanese Colleges and universities,and put forward its own ideas for the Chinese version of "Bayh-dole Act".In a word,the system of protecting the rights and interests of inventors centered on the mixed ownership of post scientific and technological achievements will certainly help the development of science and technology in China.
