Study On The Regulation Of Transfer Payment In General Public Services Provided

The transfer payment of general public services is designed to equalize the fiscal capacities in different areas of China and facilitate the indiscrimination of the general public services provided by the government.Based on the current situations of transfer payment of general public services in China,this paper discusses the shortcomings and analyzes their causes while discusses the necessity and feasibility of legal regulations on the transfer payment system of general public services by referring to successful foreign experiences and then proposes suggestions for the regulation.This paper consists of 4 parts:Part 1 illustrates the fundamental theories of general public services.Firstly,it analyzes the basic concept of general public services to determine the view of the study and defines the requirements for the general public services provided by the government;secondly,it analyzes the security effect of transfer payment to the general public services provided by the government.This part also conducts an analytic demonstration of the problems of the transfer payment system and their causes by studying the fundamental theories of general public services.Part 2 analyzes the problems of transfer payment of general public services and their causes,and explores the problems of the transfer payment system in the general public services provided by the government,including the budget,capital scale,payment process and procedure supervision of transfer payment.It also analyzes the causes after determining the problems and finds the root to decide how to solve the problems by legal regulation.Part 3 analyzes the necessity and feasibility of legal regulation on the transfer payment of general public services and explores the current situations of transfer payment of general public services provided by the government.It also analyzes the necessity of applying legal regulation in transfer payment of public services based on reality.Then it analyzes the current transfer payment environment,including the popularization of ruling-by-law thoughts and the accumulation of the positive sides of relevant systems,and then compares and learns from foreign legislation achievements and experiences to derive the feasibility of legal regulation.The regulation suggestions will be proposed after determining the necessity and feasibility of legal regulation.Part 4 proposes suggestions for the regulation on the transfer payment of general public services.It suggests to apply relevant laws to regulate the transfer payment of public services,including the governing principles of legislation,reasonable division of inter-governmental financial authorities and expenditure duties,,improving the procedures of the budget and final account needed for general public services and establishing effective supervision and accountability mechanisms to strengthen the capability and level of the government to provide general public services and equably and universally benefit the public.
