Discussion On The Solution Of Administrative Disputes From The Perspective Of The Study Of The Main Game

Although in recent years,the administrative dispute settlement mechanism has been relatively rapid development,but there are still obvious shortcomings,the legislation is still not perfect,the judicial system is still not perfect.In addition,under the influence of the thought of "heavy power,light weight,heavy entity,light procedure",the administrative subject is relatively strong in the confrontation of the administrative relative person.These are directly reflected in the legal practice of the state of the legal relationship of administrative disputes.Therefore,the study of administrative dispute,with equal confrontation and mutual balance as the starting point,the game to explore the relationship of the parties,status,interests,will be conducive to the construction of administrative dispute resolution mechanism,is conducive to fully express the interests and aspirations of all parties,so as to further the proper settlement of administrative disputes.This paper will study the game theory into the administrative dispute resolution mechanism,with a new perspective of comprehensive administrative law enforcement system.Based on the administrative dispute and game theory,the theory fit of subject of administrative dispute,rules and information of game specific analysis,finally in the above analysis based on trying to build based on game players mode of administrative disputes.This paper is divided into four parts:The first chapter gives a brief overview of the dispute and the administrative dispute resolution mechanism.First of all,through the analysis of the relevant concepts of administrative disputes,the basic concept of administrative dispute resolution to make a reasonable explanation.The second chapter analyzes the administrative dispute resolution mechanism and the game theory in the theory of fit,for the use of game theory analysis of administrative law enforcement system provides a theoretical basis for the following.This chapter from the comprehensive administrative law enforcement and game of death in the basic elements of commonality,the spirit of the essence of the common,the consistency of value pursuit,Research perspective on similarity are analyzed,so that the game theory is used to analyze the necessity and possibility of the mechanism of administrative dispute resolution.And using the knowledge of game theory,the administrative law enforcement system of our country has been analyzed in detail.Third chapter analyzes in front in the foundation,in view of the reality of the administrative dispute in the main game,guide and adjust the interest orientation,psychological adjustment factors,strengthen standard guide and to strengthen information communication and other three aspects of the administrative dispute resolution mechanism put forward relevant improvement suggestions.
