The transformation from the civil dispute to the criminal case," which is abbreviated as 'CTC' in this article",is a peculiar criminal phenomenon.Its special logic of occurrence and development surpasses people's anticipation to the safe and order and threats the society's security and harmony.At the situation of frequent occurrence of the "CTC" crime and at the times of structuring harmonious society,the research of the "CTC" has significant practice and theatrical significance.This article has three parts,except for the introduction and concluding remark.The introduction is a brief introduction to research significance, current situation,method and theory contribution of this Research subject.PartⅠA summary to "CTC".At this part,the author gives the Concept of the "CTC",at the base of the analysis to three key elements, which are "Dispute among the people","transfer" and "Commit a crime". Concept of "CTC" is that the civil dispute evolves into the criminal case because the dispute among the people hasn't been handled properly.The author analyses the characteristic and type of the "CTC" thoroughly, basing on the cruising data.The connotation and extension of the "CTC" is made clearly at this part.PartⅡDynamics analysis to the "CTC".The author analyses the production inside and outside mechanism of the "CTC".With the method of the criminal psychology and sociology.Whose inherent force is that mentality generates mechanism,external force is that the dispute among the people doesn't been handled well and bad social factor.Among them, improperly handling is the direct agent of "CTC",but bad social environment dispute among the people is the formation of defect personality and occurrence of the "CTC".Inherent force is the root cause of the "CTC",external force is condition of the "CTC".External force take its role through inherent force.PartⅢPreventive measure against the "CTC".according to the Characteristic and Origin of the "CTC",the author give the suggestions and advices to prevent the "CTC",which are from the angle of molding the members of different social classes 'personality perfectly,improving social environment,and establishing convenient,effective,fluent mechanism to solve the dispute.The suggestions and advices are molding perfect personality and improvement social convention by education, establishing early dispute warning mechanism,constructing multiplicative dispute solving mechanism,completing the countryside legal help system construction,attack the "CTC" severely,strengthening the surveillance,guarantying the solution to dispute fairly.Concluding remarks induced the primary intention of this article briefly with the aid of Cuss's story.The importance of this research problem is that the practice of Preventing against the "CTC" needs the support and direction of theory. Because of this need,this research must base on the real diagnosis inevitably,the sufficient cruising data must gained from the practice.And the theory achievement must be utilized unceasingly to the practice to accept the examination of the practice.Basing on this consideration,the author has done certain empirical study,but because limit of resources and time.In the article,massive dates have to draw support from the dates which are in the article provided department in practices. Simultaneously,this article's results of the research must accept the examination of the practice further.
