The Legal Obstacles And Solving Countermeasures Of Financing For Bank's Acceptance Bill

Because of its strong liquidity and good credit,bank's acceptance bills become the most widely used long-term commercial bills,which play an important role in the bill market of our country.As a long term commercial bills,the bank acceptance bill can realize the functions of financing through acceptance,discount and rediscount.And discount is one of the most popular financing methods in practice.However,there are still many deficiencies in the system,which affect the financing of the bank acceptance bills in the current legislation of bill and financing legislation in our country.By using the method of literature analysis and comparative study,this paper makes an analysis of the legal obstacles to the realization of the financing function of the bank's acceptance bill in our country.This paper found that there are four legal obstacles of the bank acceptance bill,including real transaction relationship,unconditional payment,subject limitation and short-term payment term,as well as the negation of blank endorsement.According to the existing legal obstacles,the paper puts forward the following countermeasures.First,the legal restrictions on the background of real transactions should be abolishedthe.Second,The legal characteristics of unconditional payment should be made clear.Third,multiple subjects and payment terms should be constructed.Fourth,the legal effect of blank endorsement should be recognized.These reasonable solutions can get rid of the legal barriers of bank acceptance bills,and give full play of the bank acceptance bill to the important role of the bill market,as well as promoting the application of the bank acceptance bill in economic activities.
