As a future potential industry,game industry becomes more and more important in the world industry structure.The game has nearly 60 year history since the first game was born.Game industry has a slow develop speed in the beginning,take off rapidly in the 90 s,in the 21 st century game industry is growing at a high speed beyond most of traditional industries.The rapid develop of game industry also brings intellectual property issues,a growing number of game infringement case,copying,adaptation,reproduction,all kinds of games have suffered this fate.Whether the game constitutes a work,constitute what type of work,which protected mode should be taken has lots of dispute in academic circles.The copyright protect of game has also been a research hotspots.This paper will research on these issues.Chapter I research on the back ground,methodology and innovation place.Through the history of game industry,propose the problem of game industry copyright protection.With case that judicial practice in determining problems in video game copyright infringement.Introduction writing of four methods for research and innovation.Chapter II introduce the video game's concept,a specific,especially the fuzzy definition of video game,solving the problem of classification confusion,and introduces the game industry developments,copyright infringement issues on the game industry.Research on the copyright of the video game questions and the protection mode.Citing foreign points of dispute and foreign games copyright of historical copyright issues of the in-depth analysis of the game.Simultaneous analysis of video game works,challenged all points of view in the past,that determine the type of video games should be determined according to the difference of the game itself.Research on the rational use of the game,focuses on the analysis of whether the live broadcast of the game constitutes reasonable use.Chapter III research on the infringement asserting on video game,classify acts of copyright infringement of video game.Through the analysis of cases about game copyright infringement asserting,in-depth analysis of the methods of infringement,discusses judicial practice in the controversy.Chapter IV propound that explicitly game work properties in copyright law.Establish video game multiple protection modes,redefine video games copyright infringement asserting.
