Study On Body Language Of Suspects' False Confession

Body language is a kind of nonverbal expression to convey information or release mood through movement of body parts,it is the important supplement of sound language.Many industries both at home and abroad have done the effective research and application of body language,but in the field of criminal justice in our country,the research of the criminal suspect body language is slightly insufficient,the main show is less number of research literature,lack of empirical research,simplex of research method,etc.In general,the criminal suspect will make a false confession to escape conviction in the case of key issues,but the criminal suspect and innocent person may have different characteristics in body language because of the differs in psychological pressure and the level of cognitive load.Study the criminal suspect body language in false confession will enrich the interrogation methods,improve the ability of interrogators to identify false confession,which is beneficial to deep dig the crime,and we also have the feasibility of research from the theoretical and practical point of view.On the basis of existing research,we will explore the criminal suspect body language features of false statements in preliminary through experiment : set up a simulate crime situation,60 person were divided into experimental group(‘the suspect')and control group(‘the innocent'),each participants interrogated in turn by two in-service officers,then compare two groups index differences in action occurred frequency and duration.Seen from the results,this paper's hypothesis "When criminal suspects in the false confession,its body movements occurred frequency and duration was significantly different from the innocent" is verified by the experiments.Conclusions:1.The suspects who make the false statement show the overall characteristics of the number of actions and the duration is short in the body language,as compared with the innocent people who are truthfully stated.Its hand movements on the embodiment is particularly evident,followed by the legs,the head is not reflected.Therefore,the interrogators in the observation of the subject matter of the body movements should be a comprehensive and have to grasp the point,and should focus on observation of the hands of the action of the number of actions,duration of action,as well as the duration of leg movements.The head action can only be of general concern.2.In the "gestures" and "rub your fingers" two specific actions,there is a statistically significant difference between the suspect and the innocent which means the performance of the suspect gestures more frequently with a long time,and rub the fingers more frequently while time is short.When the trial object appears to these two actions,the interrogators should carefully observe and carefully record.Differences between the two actors in the two actions can be used as a basis for distinguishing between suspects and innocent people.3.The interrogator should take full account of the individual differences between the scene and the subject to avoid blind and one-sided,so it can improve the scientific nature of the analysis and determine the accuracy.This experiment is only a preliminary exploration,the applicability of the conclusion need to be tested by the practice.we should enrich the existing experimental research results as well integrate other scientific and technical methods to improve the content of interrogation.1.
