Research On The Investigation On Illegal Business Operation Crime Cases Of Tobacco In Network

Tobacco crimes have been taken high pressure to suppress for many years in China,however,with the rapid development of Internet communications,logistics express and third-party payment,illegal business operation crimes of tobacco gradually shifted to the network.Criminal means are more subtle.Membership is more complex.The influence is more extensive,which poses a seriously damage to China's tobacco monopoly system,the financial tax and the vast majority of consumers' the legitimate rights.Investigative organizations are also facing a great challenge.Against this background,it has an important theoretical and practical significance to analyze the means and characteristics of crime,to adjust the investigation ideas,to summed up the technical methods and to systematically study the investigation countermeasure.This article is divided into five parts to elaborate the investigation on illegal business operation crimes of tobacco in network.The first part analyzes the tobacco monopoly system and its criminal incentive,and discusses tobacco crime determines,and distinguish demarcating line of the crime and not guilty.The second part summarizes the criminal process of releasing tobacco sales information,consulting communication,logistics distribution,fund settlement and the characteristics of crime.The third part analyzes the dilemma from the perspective of criminal investigation in practice.Investigative organizations are facing challenges about case clues acquisition,seizing the suspect and gathering evidence.The fourth part is the core part.Through summarizing crime law,and analyzing of weak points in the criminal links,and combing with typical Ministry of public security supervision cases' investigation methods,this part tries to extract technical methods of using internet to develop investigational informatization,which aims at forming a three-dimensional fight against crime.At the same time,it discusses the improvement of the forensic process and the problems that should be paid attention to,which lay the foundation for the prosecution.Based on the high incidence and repetition of tobacco crime,the fifth part discusses how to control the source of crime in order to address both the symptoms and root causes,which can offer information support in the process of criminal investigation.
