New psychoactive substances are substances that have chemical properties similar to drugs which can cause addiction,but most of them have not yet been regulated by law.In recent years,as the drug market has been compressed,the manufacture,trafficking,transport and abuse of new psychoactive substances have risen.The pharmacological properties of new psychoactive substances are similar to those of synthetic drugs.New psychoactive substances endanger human health by causing physical and mental illness,while threatening social safety and public health.Therefore,strengthening the control of new psychoactive substances is of great significance to the maintenance of social order and the prevention of crime.As the new psychoactive substances have the characteristics of rapid change and increasing types,the traditional legislative means cannot be qualified to control it.Legislation and afterwards management run at slower rate than the pace at which new psychoactive substances developed."One size fits all" type of prohibiting stipulation will inevitably impede the normal production of pharmaceutical and chemical production,making it difficult to carry out medical and scientific research work.This contradiction urgently needs to innovate the control method and explore effective ways to solve the problem.In addition,the international drug control work relies on the progressive improvement of international conventions and the collaboration mechanism of law enforcement between countries.The lack of basis to carry out joint actions leads to weak control in the international scope.It is particularly necessary to establish an efficient and unified collaboration mechanism.The government should implement integrated management,which can make up for the limitations of legislative control means.Based on the investigation work experience on crime of trafficking in or manufacturing new psychoactive substances,as well as domestic and foreign management practices,the government can improve the precaution and control of new psychoactive substances in the following respects: first of all,strengthen the monitoring and early warning of new psychoactive substances,and reverse the passive work situation.Secondly,improve the efficiency of legislation,using flexible and dynamic way to carry out prohibiting stipulation.Furthermore,establish harmonized mechanism of involve departments,and enhance the defense capacity.Last but not least,intensify the propaganda and education of new psychoactive substances prevention,and mobilize social resources to build precaution and control system.
