The Research On Duty Counsel System

With the Duty Counsel System of foreign countries and the domestic System for the Duty of Legal Aid Lawyer as the study objects,the thesis aims to make contributions to the construction of System for the Duty of Legal Aid Lawyer with Chinese characteristics through the introduction of the development of the Duty Counsel System of foreign countries and the analysis of the Pilot work related to the our domestic System for the Duty of Legal Aid Lawyer.The first part is theoretical generalization which introduces the origin and the development of Duty Counsel System and also talks about the related definitions and features in general.The second part talks about the observation and analysis of the Duty Counsel System of foreign countries which is one of the main study objects.General characteristics are concluded through the introduction of Duty Counsel System in the United Kingdom,Canada and New Zealand.The third part analyzes the necessity and feasibility of constructing the System for the Duty of Legal aid Lawyer in our country at the present stage,aiming to provide some reference assets for the construction of System for the Duty of Legal Aid Lawyer stated in the later parts.The fourth part talks about the main point that need to be analyzed which is the pilot work for putting the System for the Duty of Legal Aid Lawyer into practice in some testing area.Based on the knowledge of the current situation,we can catch a sight of the deficiencies and problems shown in the testing area,which will build foundation for constructing the System for the Duty of Legal Aid Lawyer.The fifth part is about the construction of our domestic System for the Duty of Legal Aid Lawyer,which is the most important content in this thesis and also the end-result of it.In this part,on the basis of the analysis the development of foreign and domestic duty counsel system and the progress of the pilot work in our country,the author talks about constructing a domestically applicable System for the Duty of Legal Aid Lawyer from the following aspects: the funds for Duty Counsel System,the election and assessment of the duty counsel,the function of duty counsel,the responsibility of duty counsel and etc.
