On The Dilemma And Solution Of My Country's Suitable Adult Participation System

At present,the crime rate of juvenile minors in our country has been increasing year by year,the way of crime has shown diversity,and the crime characteristics are manifested as younger age,violence-oriented,means of adult-oriented and grouping trend.It is concerned highly by the criminal law and Criminology scholars that how to deal with juvenile delinquency.The appropriate adult participation system introduced by China in the Criminal Procedure Law,which was revised in 2012,opens up a new direction for the solution of this problem,which is different from the legal agent’s presence in China’s criminal procedure law to maintain legal procedures.The appropriate adult participation system is an important legal system to safeguard the rights and interests of the suspects in juvenile criminal cases.In the period of torture and litigation of juvenile criminal cases,appropriate adults are allowed to participate in,through strict supervision of judicial procedures.Way to change the current status of juvenile delinquency,the juvenile delinquency through the juvenile justice system is different from adult criminal offenses.This system has been faced with many problems since the introduction of our country.However,this article introduces the appropriate adult participation system in the criminal procedure law,through the display of the status and problems of the appropriate adult participation system in our country and the reasons analysis,and reference to the practical experience outside the field,for Chinese appropriate adult participation system facing the development dilemma proposed a wide range of solutions.The whole article is divided into three parts:The first part is to analyze the plight and reason of the appropriate adult participation system in our country.In this chapter,the author mainly introduces the existing problems such as the legislative defects,the local cultural conflict,the lack of operational management of suitable adult management and the lack of funds,and analyzes the causes of the problems.The second part is the external perspective of the appropriate adult participation system.In this part,the author summarizes the similarities and differences between the Sino-British and the appropriate adult participation system by introducing the content of the most mature British adult participation system in this way.And finally obtains the enlightenment in the horizontal comparison to the development of the appropriate adult participation system in our country.The third part is the solution of the system of appropriate adult participation system in our country.The author,mainly through the clarification of the solution,puts forward the concrete solutions to solve the plights of the development about the appropriate adult participation system in China.Meanwhile,the author put forward some suggestions in the areas of perfecting legislation and regulations,introducing the idea of "caring the young" into the system of suitable adult participation,clarifying the management and operation mode of the suitable adult team and increasing the financial support for the suitable adult service system.
