Study On Constructing The Cooperation Mechanism Of Genetic Resource Protection Between Chinese Government And The ASEAN

Genetic resources are of great social and economic value.Since 1990 s,transnational corporations and research institutions from developed countries have taken advantage of their technology and capital to obtain developing countries' genetic resources and traditional knowledge freely or with a low price.Developed countries grab huge profits by selling commercially developed resources to countries providing genetic resources.The legitimate interest of genetic resource owners,indigenous communities and related countries is damaged severely.China and Southeast Asian countries,whose mountains and rivers are linked and climate is similar,own a great quantity and variety of common genetic resources,which are subjected to critical bio-piracy form developed countries.At present,China and Southeast Asian countries have been aware of the importance of the genetic resource protection,showing a tendency to protect the genetic resource jointly.However,the cooperation process between China and Southeast Asian countries has been blocked and unable to curb the increasing biological piracy due to many factors.From the perspective of inter-governmental cooperation,this thesis suggests that the Chinese government and Southeast Asian countries should extract the issue of genetic resource protection from other issues and put it on the governmental agenda of China-ASEAN region with the help of the "One Belt and One Road" strategy.The Chinese government and Southeast Asian countries can establish an intergovernmental consultative regime of genetic resource protection and then select a dominant country.The dominant country and teams of genetic resource protection,which are organized by the dominant country,will be responsible for steadily pushing forward cooperation projects including coordinating intergovernmental legislative basis on the genetic resource,enhancing protection capability of genetic resource protection,promoting genetic resource documentation and setting up a trust fund in China-ASEAN region.Only in that way,can China and Southeast Asian countries give full play to the leading role in the field of genetic resource protection,and improve the will and ability of participating in the formulation of international rules for the genetic resource protection.
