Citizens' Personal Information Protection Under The Background Of Big Data The Legislative Studies

The protection of personal information has always been the world's attention.Developed countries like the United States and the European Union area,enacted a series of laws and regulations in such early years that gives the law a clear range of definition about personal information.While the relevant legislation starts relatively late in our country,china has been on the way to explore more.In the era of big data,the personal information of citizens has changed from simple natural person identification symbols to basic resources with important market value.Driven by big data technology,the ability to collect and use information has been making a qualitative breakthrough.Big data technology is gradually replacing the traditional ways and playing an increasingly important role in collecting of personal information,which can be further used commercially.Improper and illegal collection of personal information and leakage of the information is caused by big data technical characteristics with the diversification of sources and the lack of effective supervision.This phenomenon is very common in both home and broad,especially in China because of the fact that the legal system of personal information protection is not yet established well and the legislative process is lagging behind.The challenge and the impact to protection of personal information of our citizens is huge.By comparison,there are two different legal systems of citizen's personal information protection worldwide represented by US and EU.US is the first country to legislate for citizen's personal information protection,with over 40 laws at different leves among more than 40 years.These laws aim to balance personal information protection and the development of big data industry.Meanwhile,EU starts later than US,but the enforcement of legal system is stronger,espeically the power of the General Data Protection Regulation passed by EU Commission has been inexorably on the increase.EU emphasizes that personal information protection shall be superior to big data.There is a good deal of weaknesses among China's legal systems of citizen's personal information protection,yet speed of bid data industry's development ranks among the world,so the contradiction between personal information protection and the development of big data industry becomes more serious.Measures should be taken as below:to enact the Act on the Protection of Personal Information which is superior to the safety of citizen's personal information protection;to promote the balance between personal information protection and the development of big data industry;to legislate for international coorperation to protect citizen's personal information;to formulate detailed rules and regulations about citizen's personal information and strengthen the enforcement of laws;to perfect China' legal system of citizen's personal information protection that conformed to national conditions.
