Drug crime is a huge harm to society,so it is severely cracked down all over the world,and China crack down hard on drug crime also.However,as the most important form of drug crime,drug offences has a lot of problems in China's judicial practice for a long time.The root of the problem lies in the fact that the basic concept of drug offences in China has not been clearly defined.So this article put forward their own ideas to define it:Part ?.Summary of drug offences.This part mainly covers the general provisions of drug offences,and the problems and causes of the existence of drug offences in practice and norms.In the general regulation,we introduce the meaning of drugs in the legal point of view,the basic characteristics of drugs,the basic types of drugs and the increase and development of drug types,to illustrate the legislation should keep pace with the times;on the basis,introduce the regulations on drug offences in different countries,to explain the generality of drug crime,and then compare to find the problems in our legislation;after that sort out from a vertical perspective on China's drug offences legislation,judicial interpretation and criminal policy,to identify problems and reasons.Part ?.Understanding differences and redefinition on "trafficking"of drug offences.This part is divided into two parts:current various differences and judgments on the understanding of "trafficking" in theoretical circles,and redefine the concept "trafficking"with characteristics.Differences in the understanding of "trafficking" mainly summarize the main differences between the characteristics and concepts of "trafficking" in drug offences and evaluate;and on the basis analyze the characteristics of "trafficking" and define "trafficking" with the above mentioned idea of the article.Part ?,Analysis and definition of main argumentative "trafficking" behavior in practice and analysis of related questions.This part continues part ?,with the results of part ?,namely,the behavioral characteristics criterion to analyze several major argumentative drug circulation behavior.Include following four parts:behavior of inter mediation introduction and actor as a purchasing agent,trafficking presumption of holder,analysis and definition of behavior of drug reciprocity,barter,non-material interests exchanges and debt payments,and analysis of accomplished and attempted drug offences.
