Qualitative Research On Theft Of Virtual Property Of Network

The theft of virtual property is becoming more and more serious,which seriously affects the security of virtual property in China and the legitimate rights and interests of property owners.At present,our country criminal law about network virtual property of qualitative lack of clear rules,cause criminal court in the judicial practice of network virtual property theft behavior qualitative,seriously affecting our country judicial fairness and credibility of the verdict.This article from the typical cases of stealing network virtual property and the existing problems as the research basis,through the study of qualitative theory of stealing network virtual property in our country,in Britain,the United States and other countries of Anglo-American law system and continental law system countries such as Germany,Japan,South Korea and China mainland,Hong Kong and Taiwan on the state of stealing network virtual property legislation,on the basis of a comparative study,put forward concrete thinking about stealing virtual network property qualitative problem.the network virtual property as property in criminal law,in the protection of the property crime category,of stealing network virtual property as a theft,either did not conflict with the civil law in our country,also does not violate the basic principle of a legally prescribed punishment in criminal law.
