With the rapid development of modern information technology,kinds of information collection systems have sprung up in people's daily life.These systems mine the different information thoroughly,anytime and anywhere,forcibly placing us under the microscope of the Big data.As a new-born right,the "right to be forgotten" is the legal weapon against this kind of microscope.The European Court of justice took the lead in establishing the "right to be forgotten" through the judgment of the case,which complied with the requirements of the people to be away from the "microscope"."Right to be forgotten" is a based on the personal information right,whose purpose is to restore the relationship of memory and forgetting to the era before the Big data.By increasing the difficulty of information retrieval,it makes the information which go against people to be forgotten.In practice,using the right to be forgotten should keep the balance between conflict and interests between it and other related.At present,the European Union,the United States and Russia have even begun to have completed the relevant legislative work of the right to be forgotten,to establish a corresponding legal system,while China is still in a state of wait and see.On the path leading to the establishment the right to be forgotten,China can take the the "eraser act" which was issued by United States of California issued as a reference,by firstly issuing the laws similar to the "eraser act".It not only helps protecting of interests of juveniles in advance,but laying the foundation for the later establishment of integrated system.
