Foundation occupies very important position in the development of public welfare undertakings in China,however foundation in recent years often appears problem,leading to the slow process of the development of public welfare undertakings in China and another factor is the foundation of operation mode which hinders the development of public welfare undertakings,Foundation simply accept donations of the public and these funds are used on the charity,this model does not make the property value of public trust and then appears a Ponzi scheme,public trust system is to overcome the disadvantages of the foundation.Since Sichuan Wen Chuan big earthquake in 2008,people found that the public trust is very important on China's charity and public trust is encouraged and supported by state,the development of public trust in our country has received the widespread attention.However,in practice we will find that the project of public trust is very few,the scale of public trust is also very small,In our country,the public trust system is still in an early stage,the lack of public trust regulation makes frequent problems of public undertakings and makes a tremendous impact on the development of China's public welfare undertakings.By the relevant provisions of the regulation of public trust,Trust law for the regulation of public trust in our country law is not careful enough,so that trust law in our country cannot very good application.For example,there are a lot of public trust regulators,the regulatory agency of public undertakings applies different standard of the establishment of public trust and the rights and obligations of supervisors are not clear and so on.So,the public trust supervision system in China has a lot of problems to be solved.Firstly this paper analyzes the basic theory of public trust and then explain the problem of public trust in our country,through the introduction of foreign countries supervision legal system of public trust and comparison the public trust supervision system of other countries,according to the actual situation of our country,we can explore the public trust supervision legal system in our country,This can make our country's public trust regulation legal system more perfect and make the better development of China's public welfare undertakings.
