A Study On The Pre Legislative Evaluation System

In recent years,the pre legislative evaluation system has been attached great importance by the local legislature because it can control the legislative quality from the source.However,with the gradual development of the pre legislative evaluation activities in China,the problems such as the rough design of the evaluation model,the unclear evaluation procedures,and the weak operability of the evaluation methods are gradually exposed.The evaluation system with insufficient practical significance can no longer meet the current local legislative environment.Therefore,in order to achieve the steady improvement of the quality of local legislation,a more perfect pre legislation evaluation system should be formulated.This paper takes the pre legislative evaluation system as the research object,focuses on the combination of pre legislative evaluation rules design and local legislative environment,and tries to further improve the pre legislative evaluation system in China from a more realistic point of view.Firstly,this paper gives a brief overview of the pre legislation evaluation system,points out the necessity of establishing the pre legislation evaluation system in local areas,and makes a theoretical basis for the following research on the evaluation rules.Secondly,taking the pre legislation evaluation rules of nine provinces and cities as the analysis object,this paper points out several outstanding features and defects in the current evaluation rules,breaking through the previous literature on the local evaluation rules Then,by referring to the practice of the United States,the European Union and Japan,the advantages and disadvantages of different countries and organizations in the rule design and the enlightenment to our country are abstracted.Finally,the Enlightenment of foreign evaluation rules,domestic evaluation experience and the defects of local evaluation rules pointed out above are combined to put forward one by one The authorhopes to contribute to the design of the pre legislative evaluation rules in China.
