| The new Legislature Act was enacted in March 2015.The enactment gives the local legislature of the cities(divided into districts)environmental legislation and has great significance to solve the local environmental problems,unite environmental legal system and construct the socialist legal system with Chinese characteristics.From the time when the new Legislature Act was enforced to the end of 2016,legislatures of cities(divided into districts)have already launched a total of 82 local environmental regulations,improved the local environmental governance chaos phenomenon to some extent and made up for the hole of national environmental legislation.However,because of skimpy legislative capacity to and old-fashioned legislation spirit,there are many shortcomings and deficiencies in the local environmental legislation of the cities(divided into districts).This paper takes the 82 local environmental regulations as a sample,comprehensively use the method of theoretical analysis and empirical analysis,in order to analyze the Problems of Local Environmental Legislation in cities(divided into districts).Obviously,legislation omission,repeated legislation and absence of operability and consideration of local situations are prevalent among local environmental regulations.Those problems show as avoiding major environmental problems,trying to complete the legislation system,copying legislative content of the superior law and other similar legislation,representing departmental interests,Lacking public participation,and lacking of local characteristics and operability.To deal with these problems,this paper proposes to establish a legislative project demonstration mechanism which adhere to the problem-oriented,introduce legislative consultation mechanism to improve the innovation and democracy of legislation,and strengthen the construction of legislative team to improve the quality of local environmental legislation. |
