| According to the newly revised《Legislative law of the people’s Republic of China》(hereinafter referred to as the new《legislative law》)in 2015,the Municipal People’s Congress and government divided into districts can formulate local laws and regulations in combination with the actual situation of urban construction and management,environmental protection,historical and cultural protection,etc.in their respective administrative regions Taking the cities divided into districts in Hebei Province as the analysis sample,this paper uses the methods of empirical analysis and literature analysis to investigate eight newly authorized cities divided into districts.Shijiazhuang,the capital of Hebei Province,enjoys the local legislative power directly because of the law.Tangshan and Handan have local legislative power were respectively approved as "larger cities" by the State Council in 1984 and 1992.According to the authority and procedure stipulated in the《legislative law》and approved by the Standing Committee of the Hebei Provincial People’s Congress,Baoding City,Langfang City,Xingtai City and Qinhuangdao City have local legislative power since August 1,2015.Also,Zhangjiakou City,Chengde City,Cangzhou City and Hengshui City have been given local legislative power since March 29,2016.By the end of 2020,the eight newly authorized cities divided into districts have made local laws and regulations,which are close to the local reality and solve a series of local problems.At the same time,due to the lack of legislative experience in different districts,there are still many problems to be solved in the local legislation of the cities with districts.Therefore,taking Hebei Province as an example,it still has important theoretical value and practical significance to deeply study the local legislation of cities divided into districts newly authorized by the legislative lawBased on the comprehensive analysis of the current situation and problems of the local legislation of the newly authorized cities divided into districts in Hebei Province,this paper deeply analyzes the root of the local legislation problems of the cities divided into districts in Hebei Province.The author thinks that the main reason lies in three reason as follows:the division of local legislative authority of cities divided into districts is not clear enough;the legislative open procedure is not in place,which makes it difficult for the public to participate in the process of local legislation;the legislative supervision and restriction mechanism is weak,which leads to unreasonable local laws and regulations not being found in time.To solve the above problems,we can make targeted improvement from the following aspects Firstly,the scope of the city authority should be clarified by scientific enumeration to avoid legislation of exceeding power and repeated legislation;secondly,the construction of the legislative talents team should be accelerated,the allocation and personnel of the legislative organs should be expanded,and the legislative training should be normalized;thirdly,the publicity of the legislation in the city with districts should be strengthened,and the public participation should be expanded by unifying the legislative information through the formulation of upper law;fouthly,we should improve the legislative supervision and restriction mechanism of cities divided into districts,study and draft the work standards for record review,and establish the legislative supervision responsibility system;finally,due to the particularity of Hebei Province,we should establish the regional collaborative legislation mechanism and build the information exchange platform of Beijing Tianjin Hebei regional collaborative legislation.By putting forward these five suggestions for improvement,we hope to make some modest efforts to improve the legislative quality of cities divided into districts in Hebei Province. |
