The reward advertisement has been appearing frequently in social life.The reward advertisement has the characteristics of the compensation,the uncharacteristic and the results-oriented,and has been put into use in many domains of society.It includes criminal rewards,civil rewards and other areas.However,the existing laws of China are not clear enough to dispose some intricated practical issues.In this paper,through the two typical prize advertising disputes thorough discussion and research,find the reward advertisement law blind spots and difficult points in practice,come up with their own standpoints.The article incorporate four parts.The first part expounds the case of'Mr.Sun v.Mr.Xing's reward contract"and"Mr.Wang v.Mr.Zhu's finding notice",and gives a presetation to the verdict of the two cases.Draw out the relevant legal disputes about the reward advertisement in the case:how is the composition and nature of the reward advertisement;how to judge the authenticity of the reward advertisement;and what legal effect the reward advertisement has.The second part is a comprehensive analysis of the overview and nature of reward advertising.It includes the concept and composition of reward advertisement,and focuses on the nature of reward advertisement.Reward advertising belongs to unilateral civil juristic act or contract,and there are imparities between the civil law countries and Anglo American law system,and the judicial practice in China is more inclined to define the reward advertisement as the contract.But in brief,the author deems that unilateral behavior is more logical.The third part,combined with the defense of the two cases of the defendant and the judgment of the court,keep the relevant meaning of representation and reward advertising meaning and joking behavior analysis.Incorporating the two aspects,characteristics and legal effects arising from them.The meaning of retention,general law should make its effective evaluation;and for the behavior of tease,goodwill behavior objective meaning and the behavior based on the resolution of the evaluation,make invalid legal response.The fourth part,combined with the legal effects of the two cases,analyzes the effectiveness of the reward advertisement.This contains the actor's right of rescission and the right to demand the compensation.The right to request compensation problem.The titles of countermand,is the premise of the reward advertisement as the unilateral legal acts.
