Research On Investigation Of Criminal Legal Aid

The criminal legal aid system is aimed at protecting the right of defense which is established to ensure the poororfelons against the lack of lawyer's defense.The right of defense is a basic litigious right enjoyed by the litigants and should not be deprived of for the objective conditions like economy.Deeper improvements have been made in the criminal legal system thanks to the revision of the Criminal Procedure Law in 2012 which expanded the subjects and covered a wider range of the criminal legal aid system.From "the Opinion of Perfecting the Legal Aid System" in 2015,to "the Opinion on Lawyers'Carrying out Legal Aid Work",which was newly introduced in 2017,all show that the protection of defendants' right of defense has become an indispensable part in the reform of China's trial-centered criminal procedure.Based on the analysis of the data of legal aid cases received by the first criminal trial court of F Provincial People's High Court from 2015 to 2016.It is found that,according to the requirements of the Criminal Procedure Law,the criminal legal aid is pro forma well covered,but substantially,the assistance from legal aid lawyers is limited whenever before the trial,during the trial,or after the trial.Therefore,by learning from the successful experience of the legal aid system abroad and combining with the domestic situation of our local legal aid system,we can improve the criminal legal aid system as the following ways:perfecting the criminal legal aid organizations,fully guaranteeing the financial support,raising the evaluation and qualification criteria of criminal legal aid lawyers,and setting up the case quality security system of criminal legal aid.Only in this way,we can improve the quality of legal aid defense,and realize the basic rights of defense in the Constitution.
