Research On Public Security Investigation And Forensics Under The Background Of Criminal Litigation System Reform

Since the fourth Plenary Session of the 18 th CPC Central Committee,the "trial centered" litigation system reform has become a hot issue in the field of legal science and judicial practice,among which the public security department's investigation and evidence collection is a key issue..This paper attempts to analyze the problems and causes of the investigation and evidence collection from the perspective of the further standardization of investigation and evidence collection,and puts forward some suggestions on how the public security organs change the inherent concept and improve the Countermeasures under the background of the reform of the litigation system.Combined with questionnaire survey and survey data analysis,this paper mainly has the following conclusions:Firstly,after the reform of criminal procedure system,it brings a series of influence on public security investigation and evidence collection.Second,through the investigation of the Nanchang Municipal Public Security Bureau East Lake Branch police found 97% police that brings great challenges and difficulties to the reform of criminal procedure evidence,criminal procedure reformThird,through investigation and practice,it is found that the problems and deviations existing in the investigation and evidence collection are mainly manifested in the irregularities of the suspects,the collection certificate is not in place,the material evidence management mechanism is not perfect,the legal documents are not standardized,the technical means are not advanced,and so on.Finally,this paper puts forward the following countermeasures and suggestions to improve the investigation and evidence collection work of public security organs under the background of the reform of criminal procedure system: improving the awareness of reconnaissance and evidence collection,improving the mechanism of reconnaissance and evidence collection,improving the capability of investigators,and unifying the export of criminal cases...
