A Study On The Mortgage Of Land Management Right Under The Separation Of Proprietary Right,Contract Right And Management Right

In order to boost the economic development of rural area,make it powerful and strong,and revitalize the strategic objectives,the separation of land-ownership,contract right and management right is a creative act on land system after the previous promoting of household contract responsibility system.With the improvement of the target goal of rural life,the manufacturing management model is becoming more specialized and productive.The reason why this kind of model can go on wheels is the mortgage of land rights.An Amended Case on Rural Land Resources which was passed on Dec.29 2018 has showed that it is generally accepted that land management can be as a financial warrant,which is beyond the regulation of previous laws and provide the support on financial mortgage.However,there are plenty of shortcomings in our current legal institutions,which has a close connection with the active demand to develop the line operation on scale by the mortgage of land rights.It is also attaching great importance to restrict of the development of rural economy.Only the three-weight separation is far from enough.What is of vital importance to motivate rural economy and realize the system transition is to learn lessons from the pilot of different areas and promote the economy of rural areas.In this thesis,the three-weight separation will be presented in the following six aspects.The fist part of this thesis is about the background,the research techniques and the meaning of the topic.It aims to raise the awareness of the topic and definite the research value.The second part introduces the concept,the transition and the policy goals of the mortgage of land management rights.In the third part,the necessity and creativity of the mortgage of land management rights is showed to introduce the realistic meaning and innovative thinking of this thesis.The fourth part introduced the dilemma of the mortgage system.It is explained in unbalance of the system and the shortcomings of the regulation and the implementation mechanism of the system.The fifth part tells the exploration of the mortgage system.The representative pilot will be set from local station and the experience and inspiration can be concluded.The last part is about the specific system of the mortgage system.It is elaborated from the following three aspects,balancing the three-weight separation system,improving the legal regulations and carrying out the measures of the mortgage system.It aims to motivate and drive the development of rural economy by working out some relative rules to cultivate land right of administration.
