Investigation And Study On The Conditions Of Administration Law Enforcement And Criminal Justice Cohesion Of Pengzhou City

Along with the establishing of the concept of Ruling ofLaw and the gradual development of the judicial system reform,it's essential toenhance the cohesion of administrative law enforcement and criminal law in the process of standardizing administrative law enforcement and strengtheninglegalsupervision.From 2011,a series of administrative regulations and normative documents have been issued separately or jointly by the central authorities and relevant departments,in order to construct and improve the cohesion mechanism of administrative law enforcement and criminal justice ? In March 2014,PengzhouMunicipal Party Committee and Municipal Government jointly issued the Implementation of Strengthening the Connection between Administrative Law Enforcement and Criminal Justice,which took the lead in establishing the cohesion mechanism covering all administrative law enforcement organs,and established a series of matching systems,such as joint conference system,associated law enforcement system,transference of suspected criminal cases system,ect.guaranteeing the rapid economic development,fair and orderly market environment and a good legal environment of Pengzhou.The cohesion mechanism has come into being for 3 years,though affected by the reforming of comprehensiveadministrative law enforcement,it is still deepening and improving after several adjustment.The existing theoretical research and practical exploration of the "convergence of the two laws" is still in the initial stage,the theoretical analysis is not thorough enough,and the practice investigation is not deep enough.Taking the advantage of the convenience of long-term participation in the work,the author has carefully investigated and studied the conditionsofPengzhou city,by issuing questionnaires and conducting interviews,and has sorted out the current problems of the convergence of the two lawsinPengzhou,which are researched and analyzed from the conceptual,systematical and practical level with public management theories,such as the theory of separation of powers,the new public management theory,and the collaborative governance theory.The author considers that the reasons for poor cohesion of the two laws are that the concept of Rule of Law and administration by law has not fully established,that existing legal system,working system,information sharing system,and supervision and restraint system have not been perfect,that practical operational procedures are in short,and that the relevant staff lack of professional knowledge and skills.The author believes that the emphasis of the research on the "convergence of the two laws"should be focused on solving the procedural problem of cohesion,and suggests that scientific and effective systems should be adopted,comprehensive and specific programs should be designed,and multi-aspect and multi-direction supervision and restriction should be adopted to solve the practical difficulties of the "convergence of the two laws".Based ontheexisting research results and the investigation in practice,from the point of public administration,this article puts forward solutions and suggestions on four aspects,including changing conception,perfecting system,optimizing procedures,and strengthening supervision,hoping to provide reference for the overall advancement of the "convergence of the two laws" throughout the coungty.
