Research On The Connection Between Environmental Administrative Law Enforcement And Criminal Justice

The 19 th National Congress of the Communist Party of China(CPC)clearly put forward the idea that "clear water,clear mountains and clear water are the Silverhill of Jinshan District" and that the strictest environmental protection should be implemented.Once a good ecological environment is destroyed,it is difficult to restore it.In order to protect the ecological environment,we must maintain a high-pressure situation to crack down on crimes that pollute the environment.Ecological beauty is the greatest beauty,a good ecological need a strong rule of law to protect.In practice,the power of procuratorial supervision is often squeezed and interfered by environmental administrative power,and the link between Environmental Administrative Law Enforcement and criminal justice is seriously "broken".Therefore,on the basis of the study of its convergence,this paper takes the procuratorial supervision as the starting point to elaborate in detail.The author carries on the research from five parts:The first part,research background,significance,literature review at home and abroad,research methods and research innovation.The second part studies the basic theory.It is divided into three sub-sections: First,the environment "two law" link-up overview;second,its link-up mode of operation;third,the role of the prosecutorial supervision of the four theoretical analysis.The third part,the author from the collection of the environment "two laws" link up judicial cases,the status of judicial practice published data,which case and data analysis.Through the study,find out the general problems of its convergence,and in view of these problems for the cause of formation.The fourth part,combing the foreign "two laws" on the environment of the convergence of the relevant provisions of the prosecution and supervision,through its legislation and practice,learn from useful results.The fifth part puts forward the countermeasures and suggestions from three aspects:First,the procuratorial organ should adhere to the basic principles;second,it suggests perfecting the supervision of transferring procuratorial work and prosecution;third,the link of Environmental "two laws" in judicial practice should be carried out to improve theworking system.This paper studies the connection of the Environmental Law and the environmental law,in order to provide reference for the improvement of the system,to realize the smooth transfer of environmental protection cases,to save judicial resources,and to protect the rights and interests of the ecological environment.
