Minor Crime Empirical Study Of Sexual Abuse In Our Country

In recent years,frequent sexual assault crime minors,has said a worldwide problem.Sexual abuse of minors crime,not only a serious violation of minors is a physical and mental health,but also seriously undermined the social harmony and stability.A series of related laws and policies in our country,through legal ways to realize the protection of minors.But in judicial practice,sexual abuse of minors crime there are still some problems.This article is based on judicial practice case,by means of direct sexual assault crime minors,hope for sexual assault minor crime laws and how to perfect the defensive juvenile crimes.This paper is divided into four parts.The first part is the overview of minor crime of sexual abuse in our country.First of all,it is pointed out that China's definition of minors,and rape and child molestation charges in the specific provisions in the criminal law in our country;The second part is through the L county people's court since 2011 in cases involving the sexual abuse of minors crime researching,comparing and analyzing,inductive conclusion sexual abuse of minors crime main characteristics and reflects the social problems,such as public legal consciousness,lack of sexual assault victims minors lack of caring,safe sex education,and points out that the sexual abuse of minors crime system has many problems:Legislation on the problem,minor crime accused of sexual abuse punishment level is not clear,is not strong enough;rape and child molestation crimes exist defects in the legislation,such as rape crime object is too narrow,it is difficult to protect male sexual rights of minors;rape behavior is too single,unable to adapt to social change;only male the body of the rape,rape on women can't regulate;lewd way of defining the fuzzy;lack of minors of coercive indecency is over 14 years old;crime of child molestation of statutory sentence on the low side.In addition,the judicial process of some deficiencies,such as the judicial relief program remains to be further perfect,murdered compensation legal obstacles.The third part is the Anglo-American law system and continental law system countries outside of the legal system for minor crime of sexual abuse,how defensive minor crimes happen to analyze the social system,expounding advanced and advantage.At the same time,comparing the current criminal legislation in our country,and social protection measures,illustrating the shortcomings of legislation in our country,drawing reference significance.The fourth part is put forward to protect human rights from infringement of a variety of ways,further consummates our country criminal law of sexual assault minors;Strengthen the legal propaganda forming good social atmosphere;take care of minors,create favorable conditions for the growth of the health and safety;strengthen safety education,improving self awareness of minors.
