An Study On The Crime Of Sexual Assault On Minors In China

In recent years,sexual assault cases involving juvenile victims have occurred frequently,such as the Beijing Red,Yellow and Blue Kindergarten Case and the "Tanglanlan" case,which have aroused great concern of the public.Due to their immature body and mind,relatively lack of awareness of prevention,coupled with lack of experience and experience,juveniles are difficult to rely on their own strength to escape from danger and self-help after encountering criminals,and are more likely to lead to more serious physical and psychological injury after sexual assault.In 2013,the four departments issued guidance opinions on the punishment of sexual assault on juveniles,but for various reasons,the degree of guidance for judicial practice is still limited,which is insufficient to support the further exploration of the punishment and prevention of sexual assault on juveniles.This paper sums up the characteristics of cases of sexual assault on minors,and expounds the difficulties and obstacles encountered in the process of judicial practice exploration.Due to the lack of research on sexual assault on minors in China,the article draws lessons from the advanced experience of the system of punishing and preventing sexual assault on minors abroad,from the legislative,judicial and social perspectives.Some countermeasures and suggestions are put forward in order to prevent sexual abuse of minors.
