A Study On Chinese Prosecutors Status And Role In Appeal Process To Reverse Wrongful Convictions

In recent years,many major criminal cases have been disclosed and most of them have been found because of the revival of the dead or the appearance of real murderer instead of being solved by legal criminal appeal procedure,causing poor social impacts.It makes us envisage the status quo of the correcting process to reverse wrongful convictions in our country.As the legal supervision departments in China,prosecutorial departments are endowed with the function of handling appeal process to reverse wrongful convictions by constitution and laws.They play important roles in the correcting process to reverse wrongful convictions in China.The modification of The Criminal Procedure Law in 2012 and the enforcement of the Provisions on Criminal Appeal Cases by the People's prosecutorial departments in 2014 have strengthened and improved the Chinese prosecutorial departments' procedures and the functions in handling appeal process to reverse wrongful convictions.This paper has analyzed the status and the function of Chinese prosecutorial departments in handling appeal process to reverse wrongful convictions.With the combination of judicial practices in China and some good systems abroad,the appeal process to reverse wrongful convictions of Chinese prosecutorial departments will be improved and the supervision effect will be given to full play.
